Zantac is a highly popular medication used to treat heartburn, acid reflux, and other gastrointestinal issues. The generic name for Zantac is Ranitidine and Wal-Zan. The generic and original versions of Zantac were sold in many stores such as Walmart and CVS. The medicine could be found in capsules, tablets, and oral solutions.

The dosages varied from 75mg to 150mg per tablet. There was also a 300mg once-daily tablet available to treat peptic ulcers. The medication’s target is to reduce stomach acid. This medication is very popular and has been used by millions of people. Zantac arrived at the market in the 1980s and has been available over the counter and by prescription.

By 1987, it was the biggest selling prescription drug on the market. As of April 2020, The Food & Drug Administration (FDA) has requested to recall all Zantac products as well as its generic versions from all pharmacies. This is due to findings showing a link between the use of these medications and cancer. Store brands like Walmart and CVS do not sell the drug anymore. GlaxoSmithKline, a U.K.-based international medical entity that also helped create Zantac, has recalled all Zantac and Ranitidine products from the U.K. and global pharmacies.

ZANTAC AND CANCER

There have been numerous amounts of studies done that show evidence of Zantac causing cancer. The public questioned the manufacturer of Zantac, Sanofi, and Boehringer, about the safety of their products plenty of times. They have been known to hide cancer risks associated with their products and have been sued for deception among other factors.

Plenty of other international and domestic manufacturers of Ranitidine started to issue their requests for recalling the drug. This was because they did not trust the drug to be safe for consumers to use. People signed citizen petitions to raise awareness about this issue and to stop manufacturers from producing more.

On September 13, the U.S. Food and Drug Administration announced the findings of their investigation on Zantac. During the investigation, they found evidence showing Zantac has an unsafe level of a cancer-causing ingredient. The acceptable threshold for NDMA set by the FDA is below 100 nanograms.

Reports show that 150mg tablets of this medication contained over 2.5 million nanograms of NDMA. 150mg to 300mg tablet versions of this medication were available to consumers. The 300mg tablets of this medication were recommended to be used to treat ulcers. The patient was to take a 300mg pill every night for 4-8 weeks to treat peptic ulcers.

The ingredient called N-Nitrosodimethylamine (NDMA) was present in toxic levels in Zantac and its generic version. Usually, this chemical does not pose a threat. However, when this chemical is ingested in high amounts, it can become toxic. The medications contained levels of NDA 3,000 to 26,000 times higher than the FDA’s daily intake limit. Both the Environmental Protection Agency (EPA) and the FDA consider NDMA to be a probable human carcinogen.

A carcinogen is any substance that may promote cancer. Due to this finding, the FDA has recalled all versions of this medication. Intaking high levels of NDMA is potentially hepatotoxic, or toxic to one’s liver. Some common cancers linked with using a high level of NDMA include stomach cancer, bladder cancer, liver scarring or fibrosis, and tumors in other parts of one’s body.

Other complications present with the use of Zantac include fever, headaches, jaundice, nausea, vomiting, enlarged liver, vitamin B-12 deficiency, irregular heartbeats, pneumonia, and abdominal cramps.

WHAT IS NDMA?

N-Nitrosodimethylamine (NDMA) is a compound sometimes formed unintentionally in drugs during the manufacturing or storage process. The chemicals in Zantac and Ranitidine make the drug more susceptible to producing NDMA. When NDMA is taken, it may disrupt a person’s DNA and cause cancer. NDMA is seen as a byproduct when wastewater is chlorinated.

NDMA is also used in aviation, industrial lubricant, and rocket fuel. NDMA is used to cause cancer in rats during laboratory research. It is also seen in tobacco fumes and cured meats. Consumers need to know if there is a risk of high levels of NDMA being present in the products they buy. NDMA production can be triggered by many factors such as high temperatures or manufacturing processes.

This toxic chemical was also found in other drugs including those used to treat high blood pressure. These blood pressure drugs include Valsartan, Losartan, and Irbesartan. More research is being done on NDMA today.

THE ROLE OF THE U.S. FOOD & DRUG ADMINISTRATION

The FDA’s role is to serve as the gatekeepers of the food and drugs that enter our market. Their responsibilities include ensuring the safety of the products that enter our market. They share an enormous responsibility to uphold public health and safety.

They also set limits on how much certain chemicals or ingredients can be present in a drug. Due to the concerns with the link between Zantac and cancer, they have requested to remove all Zantac products from all markets.

PROGRESS OF ZANTAC RESEARCH

The first time the FDA announced the possibility of a link between Zantac and cancer was November 10th, 2019. Before this time, there were no concerns about the safety of the drug. It was prescribed over 15 million times in the USA. When safety concerns started to rise, many scientists studied the possible causes of high NDMA levels in the drug.

During this time, there was still research being done to find answers. Some scientists believed Ranitidine reacts with other chemicals when being manufactured or stored. This reaction may cause the drug to have high NDMA levels and become toxic.

Other studies were done to show how Ranitidine reacts with stomach acid. Some studies showed inconclusive results, stating there is no harmful reaction when the stomach and intestinal fluid mix with Ranitidine. However, other entities, such as Valisure Pharmacies, did a similar study but added nitrates to the stomach and intestinal fluid.

Nitrates are naturally found in a person’s stomach and intestinal fluid, so this setup was much more accurate. When Zantac was mixed with stomach and intestinal fluids that had nitrates, the NDMA levels exceeded the allowed amount by 3,100 times. After these findings were known, many international manufacturers of the drug stopped producing it.

In November 2019, three generic versions of Zantac were recalled from pharmacy shelves within a week. Several other pharmacies followed their lead by recalling other versions of the drug as well. On January 2, 2020, Emery Pharma filed a citizen’s petition against Zantac.

This petition was created due to the cancer risks seen from previous research and from additional findings Emery Pharma discovered from their research. They found evidence showing storing the drug in higher temperatures causes high levels of NDMA to produce as few as five days of storage. After many pharmacies recalled Zantac from their shelves, the manufacturer started seeing a drop in profit from Zantac sales.

On February 17, 2020, Sanofi, the manufacturer of Zantac, took a $186 million write-down on Zantac. During this time, multiple Zantac lawsuits started being filed and are being processed. Around early April, the coronavirus pandemic impacted legal proceedings. Litigation was carried on through telecommunication and video conferences.

During this time, the FDA released a request for pharmacies to recall Zantac and its generic versions from their shelves. Lawsuits are still being taken today. Attorneys and legal teams maintain their fight for justice and are determined to hold pharmaceutical companies accountable. As of today, there are more than 140 Zantac lawsuits filed for injuries believed to be caused by the drug.

DISASTROUS OUTCOMES

Zantac was the 50th most prescribed medication in the United States and was used by millions of Americans and people worldwide. The medication was prescribed over 15 million times a year. People used this medication regularly and relied on it to relieve them of heartburn or other common symptoms.

Unfortunately, this has caused many people to develop severe and terminal complications that greatly impact their lives. Due to the personal losses and damages, people are facing from using this drug, people are seeking answers from the pharmaceutical companies. More than 140 lawsuits against Zantac have been filed by people injured by using the drug.

More lawsuits are likely going to be filed in the future. Many lawsuits are filed as class action lawsuits. A class-action lawsuit is bought on behalf of a group of people who have suffered injuries due to others’ wrongful conduct.

The group of people who took Zantac or its generic form developed harmful conditions due to the wrongful conduct of the pharmaceutical company. It is extremely unfortunate to see how many people have been severely impacted by taking this drug. It is important to keep pharmaceutical companies responsible for the products they put on the market.

There has been a great deal of evidence showing Sanofi and Boehringer, the manufacturers of Zantac, knew about the harmful characteristics of Zantac and its generic versions. However, regardless of the overwhelming evidence about the harmfulness of the drug, some manufacturers continued to produce and sell these drugs. Zantac made high amounts of profits and eventually became the first drug to generate $1 billion in sales.

Profit was prioritized over safety. People were unknowingly intaking toxic levels of cancerous chemicals during the time these profits were being made.

EFFECTS OF ZANTAC AND RANITIDINE

Some of the known complications or conditions caused by using Zantac or Ranitidine can be debilitating. The worst outcome is death, but numerous other conditions have been linked with Zantac and Ranitidine use. There may be more discovered as more research is done.

  • Bladder cancer

  • Stomach cancer (small and large intestines)

  • Esophageal cancer

  • Liver cancer

  • Leukemia

  • Testicular cancer

  • Non-Hodgkin Lymphoma

TYPES OF LAWSUITS

The two main categories of Zantac lawsuits are class action lawsuits and personal injury claims.

In class-action lawsuits, a group of people brings a lawsuit against the party responsible for harming the people in the group. If this lawsuit is successful, the group of people who were unlawfully harmed receive compensation for the money they spent buying the drug. In personal injury claims, one individual brings forth a lawsuit against a party who has harmed them. In this claim, a person can ask for compensation based on the injuries the drug has caused them directly or indirectly.

In a class-action lawsuit, individuals part of the group are not required to play an overly active role during the lawsuit process. The main lawyers and plaintiffs usually do most of the process. In personal injury claims, the individual hurt by the wrongful party may need to play a more active role in the lawsuit.

Multidistrict lawsuits are another form of class action lawsuit. Multidistrict lawsuits are made up of many individuals who file a single lawsuit against a wrongful party. Instead of becoming singular lawsuits like class-action lawsuits, multidistrict lawsuits remain as individual lawsuits.

When numerous individuals are suing the same parties for similar reasoning, they are grouped. This makes it easier for courts to process cases. One judge will oversee all procedures relevant to the case, and all cases will be seen together in the proceedings, but each lawsuit will still be considered as an individual suit.

To determine which type of lawsuit is right for you, it is helpful to speak with an experienced Zantac lawsuit attorney in Houston who can give you advice.

TYPES OF CLAIMS IN ZANTAC LAWSUITS

In a personal injury claim, there are multiple types of claims that can be made. One of these claims may be negligence. Negligence is present when a party had the duty to protect others and did not comply with maintaining their duty.

Thus, they risk others’ lives as a result. In many cases pharmaceutical companies, manufacturers or other parties who deceived consumers about the risks of a drug may be considered negligent. In the unfortunate event of a person passing away due to taking Zantac or Ranitidine over some time, a wrongful death claim may be made by a family member or loved one of the people who passed away. Wrongful death claims fall under personal injury laws.

These claims help those who have lost loved ones find answers and justice.

ADVANTAGES OF FILING A PERSONAL INJURY CLAIM VS. CLASS ACTION

Because of the nature of Zantac lawsuits, many people suffer from great losses and damages due to taking the drug. By filing a personal injury claim because of Zantac, one can receive the compensation they are entitled to. Some benefits of filing a personal injury claim include:

  • Seeking compensation for both direct and indirect harm caused by taking Zantac or its generic versions

  • Safeguarding the safety of others by requiring changes to the drug’s ingredients or disallowing it from being sold in the market

  • Holding large pharmaceutical companies, distributors, or other wrongful parties accountable for their negligence

  • Promoting changes for legislation impacting drug manufacturing and distribution to prevent harmful drugs from entering the market in the future

Above are only a few advantages one has when filing a personal lawsuit against Zantac and its generic versions. Depending on the type of claim you file, you may be entitled to other forms of compensation as well. Class action lawsuits are very different from personal injury claims.

However, they also offer many advantages. Some advantages of joining a class-action lawsuit include:

  • Minimal involvement with lawsuit proceedings since main plaintiffs and lawyer will handle most of the process

  • Having the opportunity to meet others who share similar experiences with you and receiving community support

  • Generally more efficient than most individual lawsuits

  • One judgment is given to the whole group and everyone receives equal compensation

Both types of lawsuits are different in their ways. It is recommended for you to speak to an experienced Houston Zantac lawsuit attorney about your case to see which type of lawsuit is best for you to file.

HOW TO KNOW IF YOU QUALIFY FOR A ZANTAC LAWSUIT

To qualify to file a Zantac lawsuit, there are a few requirements one must meet. To see if you qualify to file a Zantac lawsuit, follow this link and answer the questions. When filing a lawsuit, you need to provide proof of your Zantac use.

This can be done by providing medical records, receipts of purchase, or other documentation to your attorney. If you have been diagnosed with cancer, you must provide proof of your cancer diagnosis. Your cancer diagnosis must occur after you took Zantac or its generic versions.

FILING A ZANTAC LAWSUIT

If you or someone you know has been hurt by taking Zantac or Ranitidine, you may be wondering how to start the process of filing a lawsuit. The first step to filing a Zantac lawsuit is to find a personal injury attorney. Zantac lawsuit attorneys work with cases where one party’s negligence causes injuries or wrongful death to another party.

Being diagnosed with a major medical complication due to an over-the-counter or prescription medication can be a tremendously stressful and traumatic event to go through. You should not suffer more than you already have. Having a trusted Houston Zantac lawsuit lawyer by your side will help ease the process of filing and processing a lawsuit.

A good lawyer will make sure to ease your stress during this process and make it as smooth as possible. Experienced attorneys are familiar with relevant laws having to do with your lawsuit. They are also familiar with the behaviors and tactics of many pharmaceutical companies that may be relevant to your claim.

The following are some key reasons to hire a personal injury attorney to represent you during your Zantac case:

ATTORNEYS OFFER TRUSTED ADVICE TO HELP YOU MAKE DECISIONS

Using an attorney will help you better understand your case and your options, which will help you make better decisions. For example, an attorney can:

  • Explain applicable personal injury law about your case, so you understand your rights and obligations.

  • Help you decide whether to accept a claim settlement because they can tell you whether the amount offered is fair.

  • Help you decide if you need to file a lawsuit based on their experience with other personal injury cases like yours.

NO UPFRONT COSTS

When you think of attorneys, you probably think of lots of money coming out of your pocket. In some cases, such as divorces, that is certainly the case. But harmful drug cases are different. Most Zantac lawsuit lawyers, including our law firm, Husain Law and Associates Truck Accident Lawyers, represent clients in Zantac cases on a contingency fee basis.

In a contingency fee case, the client does not pay any legal fees upfront. If and when the case resolves in the client’s favor through settlement or lawsuit, the law firm that represented the client gets paid out of those proceeds. If the case is unsuccessful, the client does not owe any attorney fees.

These types of arrangements allow clients to pursue their legal remedies when they otherwise would not be able to afford to.

PHARMACEUTICAL COMPANIES ARE IN IT FOR THEMSELVES

Sanofi, the manufacturer of Zantac, is one of the largest pharmaceutical companies in the world. Huge companies like these are equipped with legal teams ready to fight any claims against them. They employ tactics to avoid being held accountable for the damages they caused.

Experienced attorneys are familiar with these tactics. They will work towards making sure you receive the compensation you deserve.

MEDICAL COST MANAGEMENT

If you are experiencing any major health complications such as cancer due to using Zantac, you may be facing high medical bills. If another pharmaceutical company or party is at fault, they may be responsible for covering the medical costs. However, in some cases, they do not pay the expenses immediately, and you are responsible until they do.

Your health care coverage might cover some of the costs, but in many cases, there are still thousands of dollars in medical bills left for you to pay. A Houston Zantac lawsuit attorney can help prevent medical bills from causing your financial setback or ruining your credit in a few ways. They can help you sort through what is often a tangled web to figure out who is responsible for the payments.

Then they can help negotiate with medical providers to hold off on collection efforts until your lawsuit is settled, and possibly get bill amounts reduced so that less money comes out of your settlement payment.

HOLD BAD PARTIES ACCOUNTABLE

There can be several different parties who possibly can be defendants in a Zantac lawsuit. The manufacturers of Zantac have been allegedly concealing the link between Zantac and cancer from their consumers. This could be because the manufacturing company decided to prioritize profits over safety, making Zantac the first drug ever to generate a billion dollars in sales.

If these allegations are fact, it is extremely important to stop big pharmaceutical companies from knowingly poisoning their consumers. A massive amount of people have been harmed from taking these drugs when that did not have to be the case. Many Ranitidine manufacturers stopped producing the drug when they discovered the link between Ranitidine and cancer.

However, Zantac manufacturers continued to produce this toxic drug which ended up in the hands of millions of trusting patients. If we allow big pharma companies to get away with such atrocities, more and more people may risk getting hurt by them.

HOW CAN YOU FIND THE BEST HOUSTON ZANTAC LAWSUIT ATTORNEY FOR YOUR CASE?

Hiring an attorney for your injury case may be the first time you’ve had to work with an attorney. If you don’t know any personal injury attorneys, you may not know where to start. Where do you find attorneys? How do you find good attorneys?

To find the right Houston Zantac lawsuit attorney for your case, start by researching potential attorneys, meeting with your top candidates, and then making your decision. Start your attorney search by gathering a few names of potential personal injury attorneys. You can ask friends and family, search Google, or contact the local bar association for ideas.

Look for a reputable attorney or law firm that focuses specifically on Zantac cases as one of their practice areas, like Husain Law and Associates Truck Accident Lawyers, a law firm founded by an international personal injury attorney who leads a team comprised of lawyers whose specialties include Zantac case law. Even the best business law attorney is not going to be a good pick to represent you in a Zantac case. Once you have found one or more law firms that you are interested in, schedule a consultation meeting with them.

Reading about attorneys and law firms will only tell you so much. We recommend that you always meet with attorneys before hiring them for your injury case. Good attorneys understand this and will be happy to meet and discuss your case with you. You can learn more from in-person interaction than from paper.

Some questions you may want to ask are:

  • Do you or your firm have experience in going to trial when needed?

  • Will you be personally handling my case?

  • What is your firm’s experience in handling these types of dangerous drug cases?

  • Can you explain the process of filing my case and how we will work together?

  • If the case does not succeed, will I have to pay any fees or costs?

Being harmed by an over-the-counter or prescription drug can cause intense emotional trauma. You may feel defeated, exhausted, and overwhelmed. A trusted lawyer with integrity and experience knows how to deal with big pharmaceutical companies or other wrongful parties. They will work towards getting you answers and helping you manage the aftermath of the damages caused by the drug.

You will be working with them closely for a while and sharing confidential information with them. Further, their capabilities will impact the outcome of your case.

Every case has a statute of limitations which outlines the amount of time that can pass before one takes legal action. The statute of limitations for Zantac cases is two years since the day the injuries happened. Courts follow these statutes closely and rarely hear cases if the incident goes over the two years allowed by the statute.

This means you must file your claim promptly to make sure you do not pass the statute of limitation deadline set by the state.

WILL I HAVE TO GO ON TRIAL?

The goal of attorneys is to reach a settlement that fairly compensates you without going on trial. However, sometimes the party responsible for damages refuses their accountability and does not want to compensate the people they hurt fairly. When this occurs, we are not afraid of going on trial to fight for the compensation you deserve.

This may cause you to testify in court depending on the type of lawsuit you file. We know being put on trial can be a nerve-wracking situation, so your attorney will try to make the process as comfortable and easy for you as possible.

IF I RECEIVE A SETTLEMENT OFFER FROM THE INSURANCE COMPANY, SHOULD I ACCEPT IT?

Big pharmaceutical companies are backed up by insurance companies who are incentivized to avoid paying out large settlements that people may be entitled to. One tactic these companies use to avoid being held fully accountable is offering quick settlements. These payouts seem enticing to a vulnerable person facing unprecedented costs such as medical bills.

These payouts come even quicker if the insurance company knows their policyholder was at fault. Although it might be tempting to take the settlement offer, it is important to consider the possibility that your claim may be worth much more than what the insurance company is offering you. To avoid losing the compensation you deserve, you can speak to an experienced attorney who handles Zantac lawsuits and is familiar with these settlements so they can give you the best advice.

CURRENT DRUG MARKET

Unfortunately, Zantac and its generic versions are still being sold in some pharmacies. This is because the FDA did not issue a mandatory recall for all Zantac products in the U.S. Instead, they issued a request to recall all Zantac products. This request still allows for the possibility of pharmacies selling this drug. U.K. drug entity, GlaxoSmithKline, stopped manufacturing and distributing this drug to all of the U.K. and internationally.

However, in other parts of the world, there are manufacturers still making this product and selling it. It is tremendously important to be aware of these bad drugs still on the market. Make sure to stay informed and educated about any medications you may be taking.

Attorneys are committed to fighting bad drug cases to remove all harmful drugs from the market. There are plenty of other medications one can take to treat acid reflux or other gastrointestinal issues. Plenty of drugs known to treat these conditions have been proven to be much safer to use than Zantac or Ranitidine.

We hope one day all pharmaceutical companies prioritize the safety of their products over profit. Many people may have been affected by the drug without even knowing they have harmed it. If you or someone you know is taking Zantac or Ranitidine products, it is best to look at alternative medications to help treat one’s health issues.

Talk to your doctor about which medication is best for you. More and more people are receiving answers and compensation for their losses. We hope to end the suffering of all those harmed by these pharmaceutical companies and toxic drugs.
